(NASDAQ: AMAC) a provider of healthcare communication services and advanced telehealth monitoring technologies, today announced that the New York State Supreme Court has denied the Article 78 petition from the disqualified vendor who protested the City of New York, Human Resources Administration�s (�HRA�s�) decision to award its multiyear contract for the provision of personal emergency response systems (�PERS�) to AMAC. As previously disclosed, the Company was notified that, on or about August 13, 2007, New York Merchants Protective Co., Inc. (�Merchants�), one of the bidders for the contract that the Company was awarded by HRA, filed an Article 78 proceeding. In this proceeding, Merchants moved to annul HRA�s disqualification of Merchants as a bidder for the contract to provide PERS, and therefore to annul the HRA�s award of the contract to the Company. The Article 78 proceeding was filed in the Supreme Court of the State of New York, County of New York. In sum, the Court ruling upheld the City�s determination that the petitioner�s bid was not responsive to HRA�s requirement of sufficient relevant experience.
