VISICU Inc., (NASDAQ:EICU), a healthcare information technology and clinical solutions company focused on critical care, confirmed today that the pending reexamination of its patent, filed by iMDSoft, Inc., has concluded successfully with 26 claims being allowed. The VISICU patent describes and claims a system and method for providing continuous, expert network critical care services from a remote location(s). The United States Patent Office (USPTO) has concluded that the iMDSoft patent does not anticipate any of the claims of the VISICU patent and in fact does not do automated processing of patient data as does the VISICU system. The 26 claims of the VISICU patent have each been differentiated from the many cited references in two separate reexaminations. The USPTO concluded that all of VISICU claims, with clarifying amendments, are allowable over these references. The USPTOs action on the VISICU claims reaffirms VISICUs novel approach of centrally monitoring ICUs and determining when intervention is warranted. More than 180 hospitals utilize VISICUs eICU Program featuring high fidelity telemedicine and proprietary early warning and intervention software. VISICU is the first company to receive such U.S. patent protection and the first to bring remote critical care (eICU centers) to the marketplace. We are pleased to have the Patent Office again approve the VISICU patent claims and set the record straight in this matter, especially given the negative and misleading publicity put in the marketplace. said Frank Sample, chairman and CEO of VISICU. The U.S. Patent Office has made notification of this Notice of Intent available to the public on its Public Application Information Retrieval (PAIR) website (control number 90008276) which may be accessed through the general web site (www.uspto.gov). A copy of the actual notice will be available on the USPTO website shortly. About VISICU VISICU, Inc.
