Vivendi: Polish Court Denies Deutsche Telecom Request Over PTC

Vivendi (VIV.FR) said Monday that the Warsaw Court of Appeals
denied the request of Deutsche Telekom (DT) and Elektrim S.A. for
the recognition in the Republic of Poland of the arbitral award
rendered in Vienna on November 26, 2004, confirming the position of
Elektrim Telekomunikacja, or Telco, a 51% Vivendi subsidiary.
MAIN FACTS:
- After the Austrian Supreme Court, this decision marks another
and significant victory for Vivendi in its dispute with Deutsche
Telecom and Elektrim over its investment in the Polish telecom
operator PTC.
- The decision is binding and enforceable in Poland. All of
Deutsche Telecom's and Elektrim's motions for recognition in the
proceedings were rejected.
- As claimed by Vivendi since 2004 and contrary to the
assertions of Deutsche Telecom and Elektrim, the Warsaw Court of
Appeals affirmed that the arbitral award has no effect on Telco's
48% ownership of PTC.
