A Delaware judge has denied a request by Dow Chemical Co. (DOW) attorneys to disqualify Rohm & Haas Co.'s (ROH) law firm Wachtell, Lipton, Rosen And Katz from conducting discovery against Dow, The Associated Press reported Thursday. Rohm sued Dow in Delaware Chancery Court to force completion of Dow's $15.3 billion purchase of Rohm. Dow attorneys argued that Wachtell had an ethical conflict in representing Rohm & Haas in its lawsuit because the firm had represented Dow in the past on issues similar to the present litigation. The Delaware court ruled however that it wasn't convinced that allowing Wachtell to continue would prejudice the trial set to begin March 9.
