PALM BEACH, Fla., Oct. 20, 2014 /PRNewswire/ -- Global Digital
Solutions, Inc. (OTCQB: GDSI), a company that is positioning itself
as a leader in providing cyber arms manufacturing and complementary
security and technology solutions, today announced that the United
States District Court for the Southern District of Florida has issued a scheduling order setting
a trial date, along with discovery and mediation deadlines, for
GDSI's lawsuit against Merriellyn Kett Murphy, former CEO and sole
shareholder of Airtronic USA
("Airtronic").
"We're very pleased that the Court has moved so quickly to
schedule the trial early next year, commencing April 6, 2015," said Richard J. Sullivan, GDSI's President and
CEO. "This order brings us that much closer to being able to
present our well-founded case in court. We look forward to
vigorously presenting our case as the legal process moves
forward."
The Court order was issued on October 15,
2014, just six days after the Court denied all of defendant
Merriellyn Kett Murphy's motions to transfer the case to the United
States District Court for the Northern District of Illinois and to dismiss GDSI's lawsuit against
Kett individually alleging claims for:
- Count 1: Tortious interference with contract and
advantageous business relationship (interference with the
Airtronic/GDSI Merger Agreement);
- Count 2: Fraudulent inducement to contract (inducing GDSI
to loan money based on false representations regarding Airtronic's
intent to proceed with the merger);
- Count 3: Fraudulent concealment (failing to advise GDSI
of her ongoing discussions with other prospective merger partners);
and
- Count 4: Civil conspiracy.
