Trial Date Set for December 1 in Group 8760 v. Brooks Case BIRMINGHAM, Ala., Oct. 27 /PRNewswire/ -- It was announced today that the trial involving Birmingham based, Group 8760 L.L.C. (http://www.8760.com/) and Richard J. Brooks, a company co-founder and minority stockholder, will go forward on December 1, 2003. Mr. Brooks served as Group 8760's Chief Technical Officer from its founding in 1996 until August 2001, when he departed the company after a disagreement with company directors. Like many entrepreneurs Richard Brooks and his wife, Joanne, saw an opportunity to develop Internet E-commerce software and in 1993 they started a fledgling software business out of their home in Birmingham, Alabama. By 1996 the company had established a reputation for developing secure e-Commerce (B2B) software. In the spring of 1996 the company initiated designs for a software package to comply with a secure EDI data transfer standard (EDM) under development by the Gas Industry Standards Board (http://www.gisb.org/). This ultimately led to creation of the company's flagship product. In 1996 the Brooks sought investors to help the company capitalize on its successful reputation and expand the business. In August 1996, the Brooks joined in partnership with Birmingham investors, Charles D. Haines, of Haines Financial Advisers, John S. Williams and others to form Group 8760 L.L.C. Group 8760 focused on expanding the Internet e-Commerce business started by the Brooks and eventually became a leading provider of B2B, E-commerce software for the Energy Industry. Mr. Brooks is seeking legal representation in a civil matter (case: CV-02- 0777) underway within the Tenth Judicial Circuit of Alabama, Jefferson County and is currently soliciting "Requests for Proposal" from attorneys licensed to practice law in the state of Alabama. Interested parties should have expertise in Minority Shareholder Oppression techniques, as described in the seminal text on the subject, "Oppression of Minority Shareholders (1991-95)" by F. Hodge O'Neal & Robert B. Thompson. Candidates should also have successfully litigated employment law cases related to professional non- compete agreements in Alabama; a thorough understanding of Odess v. Taylor, Ala. 389, 211 So.2d 805 is desirable. Parties interested in submitting proposals must confirm that no conflicts exist with the defendants in the case (listed below): JOHN STERLING WILLIAMS, BLAIR "BOB" SULLENTROP, CHARLES D. HAINES, GROUP 8760 L.L.C, STEVEN M. DAUPHIN and TREBLE RANGE PARTNERS II (BILLY L. HARBERT JR., JAMES O. REIN, ALAN HALL, HOWARD E. DYER-SMITH, EDWARD MCSWEENEY, CHARLES R. MORGAN, ANNE H. MOULTON, ELIZABETH H. CORNAY, WILLIAM E. REISER). "I believe this case will stand as a landmark for minority shareholder rights and a warning to majority stockholders and company directors that might be considering the use of oppression tactics to squeeze-out minority owners. I'm looking for an attorney who's passionate about the protection of investor rights and putting an end to minority shareholder oppression," said Brooks. Interested parties are encouraged to submit proposals to Mr. Richard Brooks at PO BOX 148, Dracut, Massachusetts 01826. Questions may be submitted to . DATASOURCE: Richard J.
